Contact Information: If you are a Business and you opt to import or sync your Google account, contacts, iCal or similar accounts or services with our Services, we will collect and store information such as your contacts' (including contacts your services provider(s) or app automatically added to your address book when you communicated with addresses or numbers not already on your list) email address, name, address, website URL, phone number and other metadata assigned to a contact; we obtain this data in order to create profiles, suggest existing profiles for you to connect with and invite new persons to use the Services. If you activate g-mail integration on your account you consent to our use of your email account to send emails (that you draft and send using our email composer) to your customers on your behalf.
Other Information: Non-Identifiable Data: When you interact with HoneyBook through the Services, we receive and store certain personally non-identifiable information. Such information, which is collected passively using various technologies, cannot presently be used to specifically identify you. HoneyBook may store such information itself or such information may be included in databases owned and maintained by HoneyBook affiliates, agents or service providers. The Services may use such information and pool it with other information to track, for example, the total number of visitors to our Site, the number of visitors to each page of our Site, and the domain names of our visitors' Internet service providers. It is important to note that no Personal Data is available or used in this process.
We use local shared objects, also known as Flash cookies, to display content based upon what you view on our site to personalize your visit. Flash cookies are different from browser cookies because of the amount of, type of, and how data is stored. Cookie management tools provided by your browser will not remove Flash cookies. When you visit the Site or view one of our emails, we will use pixel tags or “clear” gifs to track some of the pages you visit on our Site and the actions you take. Pixel tags are a technology similar to cookies that can be embedded in online content or within the body of an email for the purpose of tracking activity on websites (for example, to know when content has been shown to you), or to know when you have taken particular actions or viewed particular content or a particular email message.
Aggregated Personal Data: In an ongoing effort to better understand and serve the users of the Services, HoneyBook often conducts research on its customer demographics, interests and behavior based on the Personal Data and other information provided to us, including information available in Vendor contracts and related proposals that you may upload. This research may be compiled and analyzed on an aggregate basis, and HoneyBook may share this aggregate data with its affiliates, agents and business partners. This aggregate information does not identify you personally. HoneyBook may also disclose aggregated user statistics in order to describe our services to current and prospective business partners, and to other third parties for other lawful purposes.
Location Information: Our Service and third parties that are integrated into our Service may collect and use your location information (for example, by using the GPS on your mobile device) to provide certain functionality of our Service. We may also use your location information in an aggregate way, as described above in the "Aggregated Personal Data" section.
You may also have the option of posting your Services activities to Social Networking Services when you access content through the Services (for example, you may post to Facebook that you performed an activity on the Service); you acknowledge that if you choose to use this feature, your friends, followers and subscribers on any Social Networking Services you have enabled will be able to view such activity.
HoneyBook and its affiliates may use Personal Data collected through the Services to inform the Businesses and Clients who use our Service about services we believe will be of interest to you. Each marketing communication we send will contain instructions permitting the recipient to "opt-out" of receiving future marketing communications. In addition, if at any time you wish not to receive any future marketing communications or you wish to have your name deleted from our mailing lists, please contact us as indicated below.
There are certain circumstances in which we may share your Personal Data with certain third parties without further notice to you, as set forth below:
Business Transfers: As we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution or similar event, Personal Data may be part of the transferred assets.
Agents, Consultants and Related Third Parties: HoneyBook, like many businesses, sometimes hires other companies to perform certain business-related functions. Examples of such functions include mailing information, advertising, maintaining databases and processing payments. When we employ another entity to perform a function of this nature, we only provide them with the information that they need to perform their specific function.
Legal Requirements: HoneyBook may disclose your Personal Data if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) protect and defend the rights or property of HoneyBook, (iii) act in urgent circumstances to protect the personal safety of users of the Services or the public, or (iv) protect against legal liability.
You can visit the Site without providing any Personal Data. If you choose not to provide any Personal Data, you may not be able to use certain Services. For example, you can read and review publicly available information on our Site without providing any Personal Data. However, you will not be able to use any creative services management and booking services without providing the necessary Personal Data.
If you are a Client in the European Union, and you would like to exercise one of the rights provided by the General Data Protection Regulation (“GDPR”) or otherwise inquire about how your Personal Data is handled under the Services, please contact your Business, who is the Controller of your Personal Data under the GDPR.
HoneyBook takes reasonable steps to protect the Personal Data provided via the Services from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, no Internet or email transmission is ever fully secure or error free. In particular, email sent to or from the Services may not be secure. Therefore, you should take special care in deciding what information you send to us via email. Please keep this in mind when disclosing any Personal Data to HoneyBook via the Internet.
Your access to and use of the Services is subject to the Terms of Service https://www.HoneyBook.com/tos.
General. We rely on our Privacy Shield certification to transfer Personal Data that we receive from the EU and Switzerland to HoneyBook in the U.S. and we process such Personal Data in accordance with the Privacy Shield Principles of Notice, Choice, Accountability for Onward Transfer, Security, Data Integrity and Purpose Limitation, Access, and Recourse, Enforcement and Liability (“Privacy Shield Principles”), as described below.
Accountability for Onward Transfers. We may be accountable for the Personal Data we receive under the Privacy Shield that we may transfer to third-party service providers. If we are and our third party service providers process Personal Data in a manner inconsistent with the Privacy Shield Principles, we are responsible and liable for the harm caused, unless we prove that we are not responsible for the event giving rise to the damage.
Data Integrity and Purpose Limitation. We take reasonable steps to ensure that Personal Data is reliable for its intended use, and that it is accurate, complete and current for as long as we retain it. We will retain the data as long as necessary for the following purposes: delivering the Services, engaging in customer service, complying with legal obligations, auditing, performing security and fraud prevention, responding to legal and regulatory inquiries, and preserving or defending our legal rights or those of other users or third parties.
Access. European Union users have certain rights to access, correct, amend, or delete Personal Data where it is inaccurate, or has been processed in violation of the Privacy Shield Principles. Please see the “European Union Clients” section above for more information on the rights of users in the EU (and, to the extent applicable, users in Switzerland).
Recourse, Enforcement, Liability. In compliance with the Privacy Shield Principles, HoneyBook commits to resolve complaints about our processing of your Personal Data.
